Experience
Tony Barron is a partner in Nixon Peabody LLP’s Litigation Department and has extensive experience handling a wide range of cases involving all types of construction, real estate, and other complex commercial litigation matters. He has tried cases in both state and federal court, handled numerous domestic and international arbitrations, and represented clients in several matters on appeal. On construction-related matters, Tony has worked on both U.S. and international projects. These projects, ranging from residential buildings to power plants, have involved both public and private funding. In the construction area, Tony has drafted and negotiated hundreds of contracts, including those related to design, construction, and joint ventures. Tony also regularly counsels clients during ongoing construction projects in an effort to minimize litigation risks.
Tony has been recognized as a “Super Lawyer” by the publishers of Northern California Super Lawyers magazine for 2009. Inclusion in Super Lawyers is based on a peer-review survey.
Representative cases
Construction and Real Estate Matters
- Represented tunneling contractor terminated from major pipeline project. Asserted multimillion-dollar claims for wrongful termination and delay, and defended against owner’s multimillion-dollar claims for excess completion costs. Case settled after mini-trial.
- Represented design-build contractor in multiweek international arbitration pursuant to UNCITRAL rules and arising out of construction of steel fabrication plant in South America.
- Defended public entity owner against $20-million-plus claim by design-build contractor arising out of on-campus housing project.
- Represented contractor in multiparty litigation involving delay and extra work claims arising out of construction of five-star ski resort facility. Successfully resolved case including lien priority issues in favor of client.
- Represented developer/tenant in multiweek arbitration against landlord, relating to highest and best use of historic resort property in Northern California.
- Represented public entity owner with respect to claims and cross-claims involving the contractor and the design team arising out of a $10 million plus telecommunications facility.
- Represented contractor in successful workout and claims resolution for financially troubled, high-end housing project in Colorado, including negotiations with owner, lender, and subcontractors.
Complex Commercial Litigation Matters
- Defended insurance company against former agent’s $25-million-plus claim for wrongful termination, and various alleged torts including fraud and interference. Obtained summary judgment with respect to all of plaintiff’s claims. Prevailed on all counterclaims and awarded all damages sought after jury trial in the Eastern District of California.
- Represented plaintiff public educational entities in numerous utility rate cases alleging the imposition of improper capital facilities fees in violation of the California Government Code. After bench trial and appeal, client prevailed on all liability and damages issues in reported decision on several issues of first impression. Regents v. East Bay Municipal Utilities District (2005) 130 Cal. App. 4th 1361.
- Represented third-party administrator in multiparty litigation relating to breach of contract and late notice claims, including multiweek jury trial in the Central District of California.
- Represented major forest products company in a series of antitrust (alleged monopolization) actions.
