ExperienceJohn Foote has extensive experience in both federal and state courts defending all phases of claims brought under federal and state antitrust and unfair competition laws, including private treble damage actions, class actions, multidistrict litigation, and government investigations. He frequently counsels clients regarding compliance with federal and state antitrust laws. For the past six years, John has been an integral part of the team defending a series of antitrust cases against a major forest products company, which included two jury trials and a unanimous and favorable opinion by the United States Supreme Court. John has also defended and prosecuted actions involving intellectual property rights, including trademarks and other trade secrets, in federal and state courts, as well as before the Patent and Trademark Office. He has extensive experience defending and prosecuting claims against officers and directors for breaches of fiduciary duty and violations of securities laws, including in the defense of class actions. In particular, he has established a significant track record in defending claims of mismanagement by officers of financial institutions, having participated in the litigation and trial of a $450 million FDIC action against savings and loan officers. John also has extensive experience coordinating and working with other counsel throughout the United States as national coordinating counsel for the defense of complex insurance coverage cases involving pollution liability. John has been recognized as a "Super Lawyer" by the publishers of the Northern California Super Lawyers magazine for 2009. Inclusion in Super Lawyers is based on a peer-review survey.
