Compounding cost and effort is the volume of electronically stored information (ESI) that often needs to be collected, reviewed, and produced. When responding to subpoenas in a governmental investigation the entire process is often amplified: timelines are accelerated; negotiation may seem impossible; a mistake may result in obstruction of justice charges. There are some things you can do. Developing a methodical approach to subpoena response will allow for better understanding, management, and reduction of the costs and burdens imposed on the organization.
